1. Introduction and Acceptance of Terms

Aloha ("Aloha," "we," "us," or "our"), provides a marketplace platform ("Service") for Pi Network users. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Definitions

• "Service" refers to the Aloha marketplace platform accessible via the Pi Browser.
• "User" refers to any individual who accesses or uses the Service.
• "Content" refers to all text, images, videos, listings, and other materials posted on or through the Service.
• "Pi" refers to the cryptocurrency of the Pi Network.

3. Eligibility and Registration

• You must be at least 18 years old to use the Service.
• You must have a valid Pi Network account to access the Service.
• You are responsible for maintaining the confidentiality of your Pi Network credentials.
• You agree to provide accurate, current, and complete information during registration.
• You may not transfer or sell your account to others.

4. User Obligations and Conduct

4.1 General Obligations

• Use the Service in compliance with these Terms and all applicable laws and regulations.
• Maintain the security of your account.
• Not engage in any activity that could harm or impair the Service or interfere with other users.

4.2 Prohibited Activities

You agree not to:

• Post illegal, harmful, threatening, abusive, or defamatory content.
• Impersonate another person or entity or falsely state your affiliation.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service for any fraudulent or deceptive purpose.
• Sell prohibited items as defined in Section 5.
• Collect or harvest personal information about other users.
• Use automated methods to access or use the Service without our permission.

5. Marketplace Rules and Prohibited Items

5.1 Listing Requirements

• Listings must accurately describe the item or service offered.
• You must have the right to sell the listed items.
• Prices must be displayed in Pi currency.

5.3 Prohibited Business Types and Content

To ensure safety, legality, and quality of listings, the following types of businesses and content are not allowed on the platform:

• Pi Coin or Wallet Handling for Others: No businesses that exchange, store, or manage Pi coins or Pi wallets on behalf of others.
• General Financial Services and Products: No listings for banking, loans, credit services, investment schemes, or financial advice — especially if unlicensed or unverifiable.
• Sexual Content or Services: No adult content, escort services, or sexually explicit material.
• Involving Minors: No businesses involving, targeting, or featuring minors (under 18), including services for or by minors.
• Illegal Activities: No businesses involved in activities illegal under local or international law (e.g., unlicensed gambling, trafficking, etc.).
• Counterfeit or Unlicensed Products: No sale or promotion of counterfeit goods, unlicensed brand-name products, or items that violate intellectual property rights.
• Drugs, Controlled Substances, and Paraphernalia: No sale, promotion, or reference to illegal drugs, controlled substances, or drug-related accessories — even where local laws permit.
• Dangerous or Regulated Goods: No firearms, explosives, hazardous materials, or other regulated physical items.
• Scams or Pyramid Schemes: No MLMs, Ponzi schemes, deceptive financial offers, or “get-rich-quick” businesses.
• Hate, Violence, or Discrimination: No content promoting hate speech, racism, violence, or discrimination of any kind.
• Misleading or Fake Listings: No false, misleading, or non-existent business entries.
• Spam or Duplicate Listings: No repeated listings or abuse of tags, names, or keywords to gain visibility.
• Any Item or Service Prohibited by Pi Network Policies: All listings must comply with the broader rules and guidelines set by the Pi Network ecosystem.

6. Transactions and Payments

• All transactions on the platform are conducted in Pi.
• Aloha charges a service fee of [X%] on each successful transaction.
• Sellers are responsible for accurately describing items and fulfilling orders.
• Buyers are responsible for reviewing listings before making purchases.
• Aloha is not responsible for the quality, safety, or legality of items listed.
• Disputes between buyers and sellers should be resolved according to our Dispute Resolution Policy.

7. Intellectual Property Rights

7.1 Aloha Intellectual Property

The Service, including its content, features, and functionality, is owned by Aloha and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit our intellectual property without our explicit permission.

7.2 User Content

• You retain ownership of the content you post on the Service.
• By posting content, you grant Aloha a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting the Service.
• You represent that you own or have the necessary rights to the content you post and that it does not violate any third party's rights.

8. Limitation of Liability

To the maximum extent permitted by law:

• Aloha provides the Service "as is" and "as available" without warranties of any kind.
• Aloha is not liable for any indirect, incidental, special, consequential, or punitive damages.
• Aloha's total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you have paid to Aloha in the six months preceding the claim.
• Aloha is not responsible for the conduct of users or the content they post.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aloha and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or related to your use of the Service, your content, or your violation of these Terms.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

10.2 Jurisdiction

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in [German City where your business is registered].

11. Termination

• All provisions of these Terms that by their nature should survive termination shall survive.

We may modify these Terms at any time. Changes will be effective upon posting the updated Terms on our platform. Your continued use of the Service after the changes constitutes acceptance of the modified Terms. We will notify you of significant changes via email or through the Service.

13. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be severed from these Terms and shall not affect the validity of any other provisions.

14. Entire Agreement

These Terms constitute the entire agreement between you and Aloha regarding the Service and supersede all prior agreements and understandings.
